Update: MSBA petitions

Rules petition: In early September 2016, the MSBA filed a petition for amendments to the Minnesota Rules of Civil Procedure that would: a) bring a number of the rules into conformity with the Federal Rules of Civil Procedure and 2) require the court to allocate 50 percent of unclaimed cy pres funds in state class action suits to civil legal services. The court referred the petition to its Advisory Committee on the Rules of Civil Procedure. In its report, the Advisory Committee recommended the court adopt a number of the proposed changes that would bring the MRCP into conformity with the Federal Rules, but recommended against adoption of the cy pres provision. Stay tuned for more information on how the court decides to proceed.

Early bar exam petition: We offer thanks to MSBA members Fred Finch and Michael Boulette, who teamed up to draft the MSBA’s petition to the court requesting changes to the Rules on Bar Admission that would allow students to take the bar exam in their third year of law school, prior to graduation. We expect the petition to be filed around September 15. The MSBA Assembly approved the recommendation to file the petition at its June meeting.
